For a Safe Maternity Experience Program

This is a preventative program and not maternity leave. The For a safe Maternity program recognizes the right of a pregnant or breastfeeding worker not to expose the fetus or breastfed child to health hazards in the course of her work. To exercise this right, the worker must provide a medical certificate attesting to the presence of dangers in her workplace that could endanger the unborn or breastfed baby. The worker must consult a doctor (or authorized professional) so that he can issue the preventive withdrawal certificate. Upon receipt, the worker must return it to her employer.

What to do when you receive the certificate?

  • You can follow the doctor's recommendations

Make sure that all sections of the certificate (form) are completed and send it to the CNESST. During the assignment, the worker retains the same salary and benefits as before. If the salary attached to the new job is different from that of the usual position, the employer can request a reimbursement from the CNESST. For this purpose, the form Financial support to the employer during the assignment of a pregnant or breastfeeding worker.
  • You CANNOT adhere to doctor's recommendations

Preventive withdrawal begins automatically. You must pay the first 5 working days at 100% of their normal salary, taking into account the schedule of the company's main activities.

Good to know

  • Financial impact

An assignment to a position shall not be considered a temporary assignment. This is not a work accident and the financial impact on your contribution is not the same. The worker's tasks must be useful for your business.

  • Who decides when withdrawal begins?

It is not the worker who decides the date of her preventive withdrawal. It is the employer who decides whether or not he is able to comply with the recommendations listed in the certificate. At any time, when the protective reassignment has begun, the employer can call a worker back to work, if he complies with the recommendations. Some communication with the CNESST may be necessary.

  • 1 month before delivery

Please note that preventive withdrawal ends 1 month before the expected date of delivery. Therefore, if you want to be reimbursed for all the hours, you must stop paying the salary one (1) month before the expected date of delivery.

  • Breastfeeding worker

The program also applies to workers who are breastfeeding and whose contaminants can be transmitted to the child through breast milk.

Work accident investigation and analysis

Following an accident, the employer must take the necessary steps to understand its causes and prevent it from happening again.

Work together

Involving your team is a guarantee of success!

01

Define roles and responsibilities

Although it may seem trivial, even superfluous, this step will lay the groundwork for your team's work. When everyone understands their role and responsibilities, it is easier to achieve objectives and above all to encourage everyone's motivation. There's nothing worse than feeling like you're working in a vacuum to undermine the group's efforts.

02

Management commitment

Management absolutely must emphasize OSH management. It will set the tone and rhythm for the activities. Its commitment is fundamental, and without it, prevention will never be a priority. A policy duly signed and endorsed by management is the first step in demonstrating this commitment.

03

Plan your activities

Planning a calendar of activities is essential in order to respect the time to devote to OHS management. Each stakeholder must be able to plan the time required to invest.

04

Perform follow-ups

Do not neglect to make close follow-ups. It is imperative that the actions are implemented. Employees will be reassured that things are taken care of and that their suggestions are recognized.
